Terms of Service
For Restaurant Owners & Operators
Effective Date: April 1, 2026
1. Introduction and Acceptance
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Restaurant Owner,” “Operator,” or “Subscriber”) and Germán Andrés López Frezza, operating under the trade name goDishy (“goDishy,” “we,” “us,” or “our”), with contact email [email protected].
By creating an account, subscribing to any goDishy plan, or using any part of the goDishy platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree to these Terms, you must not access or use the goDishy platform.
2. Eligibility
By subscribing to goDishy, you represent and warrant that:
- You are at least 18 years of age;
- You have the legal authority to enter into a binding contract on behalf of yourself or the business you represent;
- You are not prohibited from using the Service under any applicable law;
- All information you provide during registration is accurate, current, and complete.
3. Description of the Service
goDishy is a software-as-a-service (SaaS) platform that enables restaurants and food service operators to create and manage digital menus, process table orders via QR codes, manage kitchen workflow, communicate with staff, and access analytics and AI-assisted features (collectively, the “Service”).
goDishy is a technology platform only. We do not sell, prepare, handle, distribute, or deliver any food or beverages. All food and beverage transactions occur exclusively between the restaurant and its guests. goDishy acts solely as a conduit for digital ordering and communication.
4. Subscription Plans and Billing
4.1 Available Plans
goDishy currently offers the following subscription tiers:
- Essentials Plan: $9.99/month or $99.99/year — includes unlimited QR codes, table management, kitchen view, staff notifications, menu management, multi-branch support, and analytics.
- Intelligence Plan: $19.99/month or $199.99/year — includes all Essentials features plus the Claude AI Assistant, natural language analytics, menu translation, AI-powered business insights, and priority support.
Both plans include a one (1) month free trial for new subscribers. Pricing is subject to change with reasonable prior notice.
4.2 Payment Processing
All subscription payments are processed by Paddle, which acts as the Merchant of Record for goDishy subscriptions. By subscribing, you also agree to Paddle's applicable terms and policies. goDishy does not directly store your payment card information.
4.3 Cancellation Policy
You may cancel your subscription at any time. Upon cancellation, your access to the Service will continue until the end of the current billing period. No partial refunds are issued for unused portions of a billing period. Refund requests are handled in accordance with Paddle's refund policy.
4.4 Free Trial
New subscribers are entitled to one (1) free trial month per account. After the trial period, billing commences automatically unless the subscription is cancelled before the trial ends.
5. Restaurant Content and Data
5.1 Your Content
You retain all ownership rights to the content you upload to the platform, including but not limited to menu items, descriptions, prices, images, and business information (“Your Content”).
By uploading Your Content, you grant goDishy a non-exclusive, royalty-free, worldwide license to store, display, and process Your Content solely for the purpose of providing the Service.
You are solely responsible for ensuring that Your Content is accurate, lawful, and does not infringe upon any third-party rights. This includes, without limitation:
- Accuracy of prices, ingredients, allergen information, and item descriptions;
- Compliance with local food labeling and disclosure regulations;
- Correct classification of age-restricted items such as alcoholic beverages.
goDishy reserves the right to remove or disable access to any content that we reasonably believe violates these Terms, applicable law, or the rights of third parties.
5.2 Anonymized Data
You agree that goDishy may collect and use anonymized, aggregated data derived from your restaurant's usage of the Service — including order patterns, menu interactions, and operational metrics — for the purposes of improving the platform, developing new features, training AI models, and generating aggregate analytics. This data will not identify you or your guests individually.
6. Compliance with Laws
As a Restaurant Owner or Operator using the Service, you are solely responsible for:
- Compliance with all applicable food safety, health, and hygiene regulations in your jurisdiction;
- Obtaining all necessary licenses, permits, and authorizations to operate your establishment;
- Compliance with alcohol service laws, including age verification for alcoholic beverages — goDishy displays menu items as loaded by you and is not responsible for enforcement of age restrictions;
- Compliance with applicable consumer protection, tax, and labor laws.
7. Communications and Notifications
7.1 Push Notifications
Staff and owner accounts may opt into push notifications for order and operational alerts. You may disable these at any time through your device settings.
7.2 WhatsApp and Third-Party Messaging
goDishy enables you to send WhatsApp messages containing ordering links to guest phone numbers. By using this feature, you represent and warrant that:
- You have a lawful basis (e.g., the guest's prior consent or an existing business relationship) for contacting each recipient;
- You will comply with all applicable anti-spam, messaging consent, and data protection regulations.
goDishy acts solely as a messaging conduit and is not responsible for any unsolicited communications initiated by you through the platform.
8. AI Features and Disclaimer
The Intelligence Plan includes an AI-powered chat assistant built on Anthropic's Claude AI model. This assistant may respond to guest inquiries about the menu, recommendations, and restaurant information.
IMPORTANT: AI-generated responses are provided on an “as-is” basis and may contain errors, inaccuracies, or outdated information. goDishy does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content. You acknowledge that:
- The AI assistant may provide incorrect menu information, prices, or allergen details;
- The AI is not a substitute for trained staff, professional dietary advice, or medical guidance;
- goDishy is not liable for any loss or harm arising from reliance on AI-generated responses by you, your staff, or your guests.
You are responsible for reviewing and ensuring the accuracy of AI outputs within your restaurant context.
9. Service Availability
goDishy will use commercially reasonable efforts to maintain platform availability and reliability. However, we do not guarantee uninterrupted, error-free, or continuous access to the Service.
goDishy shall not be liable for any loss or damage arising from:
- Scheduled or unscheduled downtime, maintenance, or updates;
- Outages or disruptions affecting third-party services (including Firebase, MongoDB, Lemon Squeezy, WhatsApp, or any other integrated provider);
- Force majeure events, cyberattacks, or infrastructure failures beyond our reasonable control.
We do not offer a formal uptime SLA at this time. Downtime notifications will be communicated through available channels on a best-efforts basis.
10. Intellectual Property
The goDishy platform, including its software, design, trademarks, logos, and documentation, is the exclusive property of Germán Andrés López Frezza. Nothing in these Terms grants you any ownership or intellectual property rights in the platform beyond the limited license to use the Service during an active subscription.
11. Limitation of Liability
To the maximum extent permitted by applicable law, goDishy and Germán Andrés López Frezza shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, or business interruption, arising out of or related to your use of the Service, even if advised of the possibility of such damages.
goDishy's total aggregate liability for any claims under these Terms shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless goDishy and Germán Andrés López Frezza from and against any claims, losses, damages, penalties, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your breach of these Terms; (d) your violation of any applicable law or third-party rights; or (e) any claim by a guest related to food quality, safety, allergens, or alcohol service at your establishment.
13. Termination
goDishy reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law.
You may terminate your account at any time by cancelling your subscription and ceasing use of the Service. Upon termination, your data will be retained for a period of 30 days, after which it may be permanently deleted.
14. Modifications to the Terms
goDishy reserves the right to modify these Terms at any time. We will provide notice of material changes by email or via a notice within the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Argentine Republic, including the Personal Data Protection Law (Ley 25.326) and the Consumer Defense Law (Ley 24.240), without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the Argentine Republic.
